Welcome to Travel EZ Travel Agency! We appreciate your interest in our services and thank you for taking the time to review these Terms and Conditions ("Terms"). These Terms, together with your booking confirmation email ("Booking Confirmation"), outline the legal agreement that governs the use of our Service and the booking of Travel EZ Travel Services. By using our Service or booking any Travel Service through us, you agree to abide by these Terms. If you do not agree with any part of these Terms, we kindly ask that you refrain from using our Service to book Travel Services.

Changes to Terms

Travel EZ reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our Service after such changes constitutes acceptance of the updated Terms. We recommend that you save or print a copy of these Terms for your records.

Please pay particular attention to the section regarding arbitration and class action waiver, which applies to all claims brought against us in the United States.

Travel EZ Travel Provider(s): Refers to the entity providing the Travel Services available through our Service.

Traveler, they: Refers to the user of our Service and anyone making a booking through our Service.

At Travel EZ, we provide a diverse array of travel services designed to meet your every need:

Flight Bookings: Discover optimal flight options, whether domestic or international, ensuring convenience and competitive pricing.
Hotel Reservations: Choose from a wide selection of accommodations worldwide, ranging from boutique hotels to luxury resorts, all carefully curated to meet your specific requirements.

Access and Account Management

Account creation is not necessary to access our comprehensive suite of services and begin planning your next adventure with Travel EZ, however, memberships come with many benefits.

Account Creation: You must be at least 18 years old to create an account on our platform. Please note that certain travel arrangements may have specific age requirements, and travelers must meet these conditions.
Account Benefits: Your Travel EZ account provides access to a range of benefits, including tracking your travel history, participation in our loyalty program, and earning EZ Points with every purchase. Accumulate EZ Points to receive discounts on future bookings, with points retaining their value until account inactivity exceeds 60 months.
Loyalty Program: Earn 2 EZ Points for every $1 spent on Travel EZ services. Accumulate 100 EZ Points to receive a $1 discount on future purchases. Please refer to our loyalty program page here for details.
Referral Program: Engage with our referral program to earn rewards for introducing friends to Travel EZ. Details on current referral incentives can be found here on our dedicated referral page.

Access Management

Service Accessibility: We reserve the right to deny access to our services at our discretion and may modify or terminate any travel services offered through our platform without prior notice.
Third-Party Travel Providers: Travel EZ Travel Providers operate independently, and bookings made through our platform are subject to their respective terms and conditions. Travel EZ does not assume responsibility for the operations or services of these providers.
Search and Filtering Tools: Customize your travel search results using our intuitive sorting and filtering options, allowing you to prioritize preferences such as price, location, and amenities to find the ideal travel arrangements for your needs.

Travel EZ is dedicated to delivering exceptional service and ensuring your travel experiences are memorable and stress-free. Whether you're planning a solo getaway, a family vacation, a corporate retreat, or conventions, trust Travel EZ to be your partner in creating unforgettable travel moments. Cancellations, Refunds, and Changes

The cancellation policy varies based on the Travel Service booked:

Bookings cancelled within 48 hours may be eligible for a refund.
Accommodations cancelled at least 60 days before check-in receive a 50% refund.
After 48 hours, bookings are typically nonrefundable, non-changeable, and nontransferable, subject to the terms of the Travel Provider.

Booking Confirmation and Price

Upon booking, you will receive a Booking Confirmation detailing the Travel Services and pricing. Prices displayed are subject to change and may be corrected in cases of obvious error. We strive for accuracy but do not guarantee availability or accuracy of displayed prices.

Insurance

Travelers are advised to obtain suitable travel insurance to cover cancellations and other risks. Details of insurance products, if offered, will be provided during the booking process.

Liability Disclaimer

Travel EZ does not guarantee the suitability, safety, or security of resort activities or services provided by third-party vendors. It is the traveler's responsibility to assess risks and suitability before participating in any activity.

Health and Travel Documents

Travelers are responsible for meeting health entry requirements, obtaining necessary vaccinations, and carrying valid travel documents. Travel EZ is not liable for travelers denied entry due to inadequate documentation.

Limitation of Liability

To the extent permitted by law, Travel EZ is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our Service or Travel Services booked through us.

Disputes and Arbitration Provision

Please read this Section carefully. It governs how disputes between you (referred to as "travelers" or "you") and Travel EZ ("we", "us", "our") are resolved, including an agreement to resolve disputes through binding arbitration on an individual basis, rather than in court. This Section also includes a class action waiver, prohibiting travelers from participating in class, consolidated, or representative actions.

Our commitment is to ensure traveler satisfaction and the timely, efficient resolution of consumer disputes. Our two-step dispute resolution process involves: (1) an investigation and negotiation of your claim by our Traveler Support team; and if needed, (2) binding arbitration overseen by the American Arbitration Association ("AAA"), or for arbitrations outside the United States, a mutually agreed-upon arbitral tribunal. Both you and we retain the option to pursue relief in small claims court as an alternative to arbitration.

Agreement to Arbitrate (“Arbitration Agreement”)

Travelers and Travel EZ agree that any disputes, claims, or controversies arising out of or relating to our Service, these Terms, our Privacy Statement, any travel program(s), product(s) or service(s) provided by us or our subsidiaries, Travel Providers, or companies offering products or services through us, any dealings with our Traveler Support team, or any representations made by us ("Claims"), will be resolved by binding arbitration, except as otherwise provided herein. This includes Claims against us, our subsidiaries, Travel Providers, or companies offering products or services through us. This Arbitration Agreement is binding upon and benefits any third parties, including but not limited to travelers' spouses, heirs, third-party beneficiaries, and assigns, where the underlying Claims are related to a traveler's use of our Travel Services.

Small Claims Court Option

Notwithstanding the arbitration requirement, either travelers or Travel EZ may elect to pursue a Claim in small claims court if the Claim is within that court’s jurisdictional limit and does not involve class, consolidated, or representative proceedings. If a Claim initially filed with AAA falls within the small claims court’s jurisdictional limit, either party may opt to transfer the Claim to small claims court at any time before the appointment of the arbitrator by notifying the other party in writing.

Waiver of Class Actions and Representative Proceedings

You and we agree that all Claims will be conducted on an individual basis and not as a class action, collective action, consolidated action, or representative action. The arbitrator cannot combine more than one person’s or entity’s Claims into a single case, and cannot preside over any class, collective, or representative proceeding. By agreeing to arbitration, travelers and Travel EZ acknowledge that they are waiving the right to a trial by jury and to participate in class actions.

Arbitration Rules and Governing Law

This Arbitration Agreement constitutes a "written agreement to arbitrate" under the Federal Arbitration Act ("FAA"), governing its interpretation and enforcement. Arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules or other applicable rules determined by the AAA. The arbitrator will apply the laws of the State of Maryland, excluding conflict of laws principles, and the FAA. Foreign laws do not apply to the arbitration proceedings. This Arbitration Agreement can only be amended by mutual written agreement.

Mandatory Pre-Arbitration Dispute Resolution

Before initiating arbitration, travelers agree to provide us with a written Notice of Dispute ("Notice") and attempt to resolve the dispute informally. The Notice must include traveler’s name, address, email address used for reservation, a brief description of the complaint, the resolution sought, and traveler’s digital signature. If we cannot resolve the dispute within 60 days of receiving the Notice, travelers may proceed to arbitration.

Commencing Arbitration

To initiate arbitration, travelers must file a Demand for Arbitration with the AAA as specified in the AAA Rules, available at www.adr.org. A copy of the Demand must also be provided to Travel EZ's Legal Department/Dispute Resolution Provision at support@travelezta.com concurrently with filing with AAA. Arbitration will be conducted by a single arbitrator selected under the AAA Rules, at a location determined by AAA, or through videoconference or other mutually agreed-upon means.

Attorneys’ Fees and Costs

The parties are responsible for their own attorneys' fees and costs, except as otherwise provided by law or the AAA Rules. If a party demonstrates that the costs of arbitration would be prohibitive compared to the costs of litigation, Travel EZ will pay as much of traveler’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. Each party may request attorneys’ fees and costs if they prevail on claims that are groundless or brought in bad faith.

Arbitrator’s Decision

The arbitrator’s decision and award will be final and binding, subject only to limited court review under the FAA. The arbitrator may award any relief that would be available in court, but only on an individual basis and to the extent necessary to resolve the Claimant’s individual dispute.

Severability and Survival

If any part of this Disputes and Arbitration Provision is found to be unlawful or unenforceable, that part will be severed, and the remainder of the provision will continue in effect. If the class action waiver is found to be unenforceable, the parties agree that any class, collective, consolidated, or representative claims must be litigated in a civil court, and the litigation of those claims shall be stayed pending the outcome of any individual Claims in arbitration.

Conclusion

These Terms constitute the entire agreement between you and Travel EZ regarding our Service and supersede any prior communications. By using our Service, you agree to these Terms. Travel EZ may not assign these Terms without your consent.
